Sales and Cancellation/Return Policy

1. Scope of Application

This policy governs all purchases made through the online shop at www.pinaysabarcelona.com and any orders placed by telephone or email when expressly indicated.
It applies to both private customers and businesses for deliveries within Spanish territory.


2. Products and Prices

  • All prices are expressed in euros (€) and include the applicable Value Added Tax (VAT).

  • For products sold by weight (such as cured meats or fresh cuts), the final amount may vary slightly depending on the exact weight. Any difference will be reflected on the invoice or receipt.

  • Product descriptions and images are for guidance only. Minor variations may occur without affecting quality.


3. Ordering Process

  1. The customer selects the products and confirms the order.

  2. A confirmation email is sent detailing the price, shipping costs, and estimated delivery time.

  3. Payment may be made by credit/debit card, bank transfer, or any other method indicated on the website.


4. Shipping and Delivery

  • Orders are delivered to the address provided by the customer.

  • Standard delivery times are 1–5 business days after payment confirmation, except during peak periods or in cases of force majeure.

  • Cal Cabré, S.L. is not liable for delays beyond its control (e.g., courier issues, severe weather).


5. Order Cancellations

  • Before shipment: The customer may cancel the order free of charge by emailing info@pinaysabarcelona.com or calling 688 78 75 67, quoting the order number.

  • After shipment: Cancellation is no longer possible, but the right of withdrawal or return (if applicable) will apply as set out below.


6. Right of Withdrawal and Returns

In accordance with EU Directive 2011/83/EU and the Spanish General Law for the Defense of Consumers and Users:

  • Non-perishable or long-shelf-life products (e.g., certain packaged gourmet items):

    • Customers have 14 calendar days from the date of delivery to exercise the right of withdrawal, provided the product is returned in its original condition, unopened, and with all packaging intact.

    • Return shipping costs are borne by the customer, unless the return is due to an error or defect attributable to Cal Cabré, S.L..

  • Perishable food products (e.g., fresh meat, pastries, or other short-shelf-life goods):

    • Under Article 103 of the Spanish Consumer Law and EU Directive 2011/83/EU, the right of withdrawal does not apply once the product has been delivered, except in cases of defect or deterioration affecting safety or quality.

    • Any defect or damage must be reported within 24 hours of receipt, with supporting photographs, so that a replacement or refund can be arranged.


7. Refunds

  • Refunds will be issued within 14 calendar days of receiving and inspecting the returned goods, using the same payment method as the original purchase, unless the customer agrees otherwise.

9. Governing Law and Jurisdiction

These conditions are governed by Spanish law. In the event of any dispute, the parties submit to the jurisdiction of the Courts and Tribunals of Vilanova del Vallès (Barcelona, Spain), expressly waiving any other jurisdiction.
